Construction law

What are the challenges for property entrepreneurs, contractors and project developesr? On the one hand, there is a great shortage of housing, and on the other hand, there are the issues of nitrogen and PFAS.

These are major obstacles to the progress of construction. Our legal specialists are aware of the current developments in the construction sector and are able to advise on all your legal questions.

Construction law is evolving

The responsibility for the work in construction law is shifting from the client to the contractor. The contractor is increasingly responsible, not only for the execution of the work, but also for the design.

The most recent development in this area is the Quality Assurance (Building Sector) Act. The purpose of this Act is to guarantee and improve the quality of the work of the building contractor. This has consequences for the position and responsibilities in the building process of both the client and the parties responsible for the realisation of the work, such as architects, constructors, contractors and fitters.

Parties involved in the building process

Building is a complicated process involving many parties. This requires good coordination, not only in communication, but also in contract formation. How often does it happen that contracts are not properly aligned? Think, for example, of the choice of authority to settle disputes. It is extremely impractical, for example, if in the contract between the client and the contractor the Arbitration Board for the Building Industry is declared competent, while in the contract between the contractor and subcontractor the court is declared competent.

In addition, civil construction law is characterised by the frequent use of general terms and conditions such as the UAV, UAV-TI, ALIB, DNR and the like. Our specialists have thorough knowledge of the content of these conditions. At DeHaan, we are well placed to advise both clients and executing parties.
