Buying or selling a house

Do you want to sell your house and/or buy a new one? These are important steps you only take a few times in your life. There are many things to think about when buying or selling a house. Consider cases such as what if I do not get the financing? Can I still cancel the purchase if I change my mind? Is there an easement, which means that - for example - a neighbour could use my path? Or is there a long-term lease, which means I have to pay an annual amount of rent for the land?

Before signing the purchase agreement, it is important to make sure you are well informed about these matters. We can prepare the purchase agreement for you, but you can always ask us to have an independent look at the purchase agreement that your broker has drawn up before you decide to sign. We will have a look at the legal side of your purchase. This will give you the assurance that no important details have escaped your notice. That gives you the assurance that you are drawn to details that you yourself might not have noticed. Buying an apartment - for example - has other consequences than buying a house.  

For a seller it is especially important to report all the details and known defects to the buyer. The concealment of known defects can lead to you having to pay damages.

Upon the transfer of ownership, payment goes through our account. This does not only apply to the purchase price, but also to other costs such as transfer tax, council tax, the costs of the broker, mortgage advisor and registration at the Land Register.

We can include advice on and assistance with

  • the ascription. Is it better that the property is on both your names or solely on the name of one of you? The reason for this question is that the ascription has tax consequences, for now and for the future. For example, in case of divorce or death;
  • drafting and/or reviewing a contract. We also take into account uncertain factors that you will need to include in the purchase contract. For example, not being able to get the financing on time, getting a housing permit or a structural inspection;
  • whether it is advisable to draw up a cohabitation agreement or will. That way, everything is well organised and you can soon fully enjoy your new home.
  • signing of the contract at the Land Register. If the seller goes bankrupt, the house will be seized. If the seller sells the house to someone else, then you can still receive your delivery.
